We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data as this data does not directly or indirectly reveal your identity. For example, we may aggregate information regarding how you use the Website, products, and services to calculate the percentage of users accessing a specific Website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Policy.

We process much of the personal data received about you through the Website on the legal basis of BUNN’s legitimate interests in providing the Website and its functionality to you. 5) DISCLOSURES OF YOUR PERSONAL DATA

When you access or use the Website, we collect and process your personal data as described in this Policy, and disclose it . BUNN will only disclose your personal data to third parties with your consent or as permitted by law, including:

  1. We share personal data with our service providers on the legal basis of BUNN’s legitimate interests in providing you with the Website. Our engagement of service providers is often necessary for us to provide the Website to you, particularly where such companies play important roles like helping us keep the Website operating and secure. In some other cases, these service providers aren’t strictly necessary for us to provide the Website, but help us make it better, like by helping us conduct analysis or research into how we could better serve our users. In the preceding 12 months, we have disclosed the categories of personal information and sensitive personal information listed in Section 2 of this Policy to delivery carriers, credit card processors, advertising and marketing providers, data management platforms, social media services, data analytics services, third-party vendors, service providers, contractors, and other business partners to fulfill your order, to ship products to you, to process and administer payments, for customer service or related inquiries, for data analysis, for troubleshooting and website hosting, for information technology and related infrastructure purposes, for performance review, for product or service development purposes, to send you newsletters and advertising and marketing messages, to facilitate your communications with us, for data management, and for other business or commercial purposes.

6) DATA SECURITY

We use administrative, organizational, technical, and physical safeguards to protect the personal data we collect and process. Our security controls are designed to maintain an appropriate level of data confidentiality, integrity, and availability. We have put in place procedures to deal with any personal data breach.

7) YOUR LEGAL RIGHTS IN THE EEA, SWITZERLAND, and THE UK

Under certain circumstances, you have rights under data protection laws in relation to your personal data.

  1. Request access to your personal data. This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  2. Request correction of your personal data. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  3. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully, or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  4. Object to processing of your personal data. This enables you to ask us to delete or remove personal data where we are relying on a legitimate interest and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which overrides your rights and freedoms.
  5. Request restriction of processing your personal data of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  6. Request the transfer of your personal data to you or to a third party. This enables you to ask us to provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  7. Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you.

No Fee Usually Required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is manifestly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What We May Need From You

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time Limit To Respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

8) DATA TRANSFERS

BUNN is headquartered in the United States, and we have operations, entities, and service providers in the United States and throughout the world. Many of our external third parties are based outside the European Economic Area (“EEA”), so their processing of your personal data will involve a transfer of data outside the EEA.

We will take steps to ensure that your personal data receives an adequate level of protection in the jurisdictions in which we process it. Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe

9) PRIVACY RIGHTS FOR CALIFORNIA RESIDENTS

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA), provides California residents with the following rights:

  1. Right to know. You have the right to request that we disclose (a) the categories of personal information we have collected about you, (b) the sources from which the personal information was collected, (c) the business or commercial purpose for collecting, selling, or sharing personal information, (d) the categories of third parties to whom we disclose personal information, and (e) the specific pieces of personal information we have collected about you in a structured, commonly used, machine-readable format (to the extent technically feasible). To request this information you can submit a verifiable consumer request. After we receive and confirm your verifiable consumer request, we will disclose the requested information to you.
  2. Right to delete personal information. This enables you to request that we delete personal information that we collected from you and retained, subject to certain exceptions. After we receive and confirm your verifiable consumer request, we will delete (and direct our service providers and contractors to delete) your personal information from our records, unless an exception applies (for example, if we are required by law to retain that information), and maintain a record of the request. We will inform you whether your request has been complied with. If your request is denied, the response we provide to your verifiable consumer request will explain the reason for denying your request.
  3. Right to correct inaccurate personal information. This enables you to request that we correct inaccurate personal information that we hold about you, subject to certain exceptions. After we receive and confirm your verifiable consumer request, we will correct (and direct our service providers and contractors to correct) inaccurate personal information that we maintain about you, unless an exception applies. Please note that we may need to verify the accuracy of the new data you provide to us. We will inform you whether your request has been complied with. If your request is denied, we will explain the reason for denying your request.
  4. Right to Opt-Out of Sale or Sharing of Personal Information. We do not sell (as defined under the CCPA and CPRA) personal information that we collect from you and therefore do not provide a method to opt-out from such activities.   5. Right to Limit Use of Sensitive Personal Information. We do not use or disclose sensitive personal information (as defined under the CPRA) that we have collected from you for purposes other than those business purposes permitted under Section 7027(m) of the CPRA regulations and therefore do not provide a method to limit such activities.
  6. Non-Discrimination. We will not discriminate against you or retaliate against you for exercising any of your CPRA rights.

Authorized Agents

You may use an authorized agent to submit a request to know, request to delete, or request to correct on your behalf. The authorized agent can submit such requests on your behalf by following the instructions outlined in the “How To Exercise Your CPRA Rights” section above.

When you use an authorized agent to submit a request to know, request to delete, or request to correct, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the request. We may also require you to do either or both of the following: (1) verify your own identity directly with us; or (2) confirm directly with us that you provided the authorized agent permission to submit the request.

Our Verification Process

After receipt of your request to know, delete, or correct, we will provide directions on identity verification requirements which will include submission of pieces of personal information that we can match to our records. Once you provide such information and assuming we are able to verify your identity by matching the information you provided to our records, we will begin to gather information to respond to your request. For requests to correct, we may require you to provide additional documentation to rebut any of our own documentation that the personal information that you are requesting to correct is accurate.

No later than 10 business days after receiving your request, we will confirm receipt of the request and provide information about how we will process the request. We will endeavor to respond to a verifiable consumer request within 45 calendar days of its receipt. If we require more time (we may take up to 45 additional days), we will inform you of the reason and extension period in writing. If we cannot verify the request within the 45 calendar days, we may deny the request. If we deny your request, we will inform you of the reason for its denial.

Notice of Financial Incentive

We may offer you various financial incentives such as discounts and special offers when you provide us with contact information and identifiers such as your name and email address. When you sign-up for an email list or other discounts and special offers, you opt-in to a financial incentive. You may withdraw from a financial incentive at any time by opting out from our emails. Generally, we do not assign monetary or other value to personal information, however, California law requires that we assign such value in the context of financial incentives. In such context, the value of the personal information is related to the estimated cost of providing the relevant financial incentive(s) for which the information was collected.

Under California Civil Code Section 1798.83 (known as the “Shine the Light” law), BUNN members and customers who are residents of California may request certain information about our disclosure of personal data and information during the prior calendar year to third parties for their direct marketing purposes. BUNN does not currently employ a process for automatically responding to “Do Not Track” (DNT) signals sent by web browsers, mobile devices, or other mechanisms. Per industry standards, third parties may be able to collect information, including personal data, about your online activities over time and across different websites or online services when you use Website.
